Fomonium Industries Pte Ltd and its affiliates (FI) are committed to privacy rights and the protection of consumer personal information.

This Privacy Policy applies to personal information collected, used and shared by FI through our websites, services, projects, mobile applications and any other interfaces or platforms owned, or controlled by FI (each a “Service” and together, the “Services”). This Privacy Policy does not apply to non-personal information, public information or de-identified data.

We may revise this Privacy Policy from time to time at our sole discretion. We will notify you of any material changes to the privacy policy as required by applicable local laws. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use our Services after any new Privacy Policy takes effect.

 

Personal information that we collect

 

The personal information that we collect depends on how you interact with us and our Services. We collect information that you provide to us and information we obtain automatically when you engage with our Services, as described below.

 

Information that you provide to us.

We may collect the following personal information that you provide to us:

  • Purchases, Wallet and Transaction Information. In order to engage in certain transactions or purchases for the Services, you may need to provide us or third-party payment processors with your payment information and allow us to connect to your digital wallet by providing us with your public wallet address. We will never ask you or collect your private keys. We do not directly collect or store any payment card information entered through our Services or access your digital wallet, but we may receive from our third-party payment processing providers information associated with your payment card information.

  • Social media and interactive features. We and others who use our Services may collect personal information that you submit or make available through our social media and interactive features (e.g. our Discord community, social media pages and other interactive features). 

  • Your Communications with Us. We may collect personal information, such as your email address, phone number or mailing address when you request information about our Services or otherwise communicate with us.

 

Information Collected Automatically.

We may collect personal information automatically through our Services such as:

  • Automatic Data Collection. We may collect certain information automatically when you interact with our Services, such as your Internet protocol (IP) address, user settings, MAC address, cookie identifiers, mobile carrier and other unique identifiers, browser or device information, location information (including approximate location derived from IP address), Internet service provider, and metadata about the content you provide.

How we use your personal information

We use your personal information for a variety of business, administrative purposes and direct marketing purposes, as described below.

To provide the Services to you.

We use your personal information to provide our Services to you, such as managing your information, providing access to certain areas, functionalities, and features of our Services, answering requests for customer or technical support, communicating with you about the Services (and any policy changes), and processing your financial information and other payment methods to facilitate purchases and transfers via the Services.

 

Administrative purposes.

We use your information for FI administrative purposes, such as:

  • Direct marketing and marketing research;

  • Detecting, protecting against and communicating with you about security incidents and malicious, deceptive, fraudulent or illegal activity;

  • Measuring interest and engagement in our Services;

  • Improving, upgrading or enhancing our Services;

  • Developing new Services;

  • Ensuring internal quality control and safety;

  • Authenticating and verifying individual identities;

  • Debugging to identify and repair errors with the Services;

  • Auditing relating to interactions, transfers and other compliance activities;

  • Sharing information with third parties as needed to provide the Services;

  • Enforcing our agreements, policies and terms of use/billing;

  • Defending FI against claims and protecting the businesses’ rights, employees or property;

  • In the event of a merger, sale, or other transfer of company assets; and

Marketing our Services.

We may use personal information to tailor and provide you with content that relate to FI current or future projects or Services. We will not sell or provide your personal information to any third party for marketing purposes. Other purposes.

We may use personal information:

  • for other purposes that are clearly disclosed to you at the time you provide personal information or with your consent; and

  • to create de-identified and/or aggregated information, such as de-identified demographic information, de-identified location information, information about the device from which you access our Services, or other analyses we create.

 

How we disclose your information to others

We may disclose your personal information to third parties for a limited variety of business and administrative purposes, as described below.

  • Blockchain transactions. Transactions involving our NFTs will be conducted on the relevant blockchain protocol. Information about your transfers will be provided to the blockchain and may be accessible to third parties due to the public nature of the blockchain. Because entries to the blockchain are, by their nature, public, and because it may be possible for someone to identify you through your pseudonymous, public wallet address using external sources of information, any transaction you enter onto the blockchain could possibly be used to identify you, or information about you.

  • Transaction parties. Some of your personal information may be visible to other individuals engaging with the Services or who you transact with (e.g., information featured on generally accessible parts of the contracts or on a user profile). In addition, to complete transfers via the Services, we will need to share some of your personal information with the party that you are transacting with.

  • Service providers. We may share your personal information with our third-party service providers who use that information to help us provide the Services. This includes service providers that provide us with IT support, hosting, customer service, and related services.

  • FI affiliates. We may share your personal information with members of our corporate family.

  • Protection and security purposes. We may access, preserve, and disclose personal information to external parties if necessary to comply with law enforcement or national security requests and legal process; to detect and protect against security incidents and malicious, deceptive, fraudulent or illegal activity; to protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.

  • Merger, sale or other asset transfer. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction, as permitted by law and/or contract.

 

Your privacy choices and rights

  • Email Communications. You may opt out of receiving email marketing material from us at any time by writing to hello@fomonium.com. We may nevertheless send you certain non-promotional communications regarding us and our Services, and you will not be able to opt out of those communications (e.g., communications regarding updates to our Terms of Service or this Privacy Policy).

  • Cookies. You may stop or restrict the placement of cookies on your device or remove them by adjusting your preferences as your browser or device permits. However, if you adjust your preferences, our Services may not be provided properly.

  • Access to personal information. In accordance with applicable law, you may have the right to access personal information about you, request correction of your personal information where it is inaccurate or incomplete, request deletion of your personal information, request a restriction of our processes of your personal information for marketing purposes and withdraw your consent to the future processing of your personal information.

 

Security of your personal information

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure.

 

Retention of your personal information

We store the personal information we collect as described in this Privacy Policy for as long as you engage with our Services or as necessary to fulfil the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defences, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
